1. Acceptance of these terms
These Terms of Service (“Terms”) govern your access to and use of Cardel at cardel.io, including account registration, Cardel pages, billing for Cardel workspace subscriptions, Shop checkout when a site owner connects Stripe, public scheduling when a site offers it, and creator sites hosted on Cardel (together, the “Platform”). By creating an account or using the Platform, you agree to these Terms and the Privacy Policy. If you do not agree, do not use the Platform.
2. What Cardel is
Cardel provides a home for your craft. Authors, professionals, and creators use Cardel to share and sell their work, grow their audience, and bring their community together on a site of their own. We host those sites on shared infrastructure we operate. You do not receive a separate cloud project to manage unless we expressly offer that in a future enterprise arrangement.
3. Eligibility
You must be at least the minimum age required by applicable law to form a binding contract, and you represent that you have the legal capacity to agree to these Terms. If you use Cardel on behalf of an organization, you represent that you are authorized to bind that organization.
4. Accounts
You are responsible for the accuracy of your account information and for keeping credentials secure. You must promptly notify us of unauthorized use. We may require email verification before certain features. One Cardel account may hold memberships in more than one site.
5. Sites and content
If you create or administer a site, you are responsible for content published there, for how you invite admins and readers, and for complying with laws that apply to your audience (including marketing and privacy rules for lists you manage). What you build is yours: your site, brand, and audience. You grant Cardel a limited license to host, display, transmit, and back up your content solely to operate the Platform.
You must not upload or distribute unlawful, infringing, harmful, or abusive material, or use the Platform to spam, attack, or disrupt others. We may remove content or suspend sites that violate these Terms or create risk to the Platform or other users.
6. Acceptable use
- Do not attempt to access another site's data without authorization.
- Do not probe, scan, or overload Platform infrastructure.
- Do not reverse engineer the Platform except where law permits.
- Do not use Cardel to send bulk unsolicited email in violation of anti-spam laws.
- Do not upload or send to purchased, rented, scraped, or other third-party email lists without lawful, documented consent from each recipient. Site admins may only add people who have consented to receive mail from that site.
- Cardel may investigate elevated bounce or complaint rates and may pause outbound email or suspend a site to protect recipients and Platform reputation.
- Do not misrepresent affiliation with Cardel or other creators.
7. Plans, billing, and entitlements
Some features require a paid Cardel workspace subscription (for example Starter, Pro, or Business). Prices, billing intervals (monthly or yearly), limits, and entitlements are described on the Pricing page and on each workspace Billing page. Subscription payments are processed by Stripe through Checkout and the Customer Portal. You enter card details only on Stripe. Cardel never receives or stores your payment card number, CVV, or other full card details. Fees are generally non-refundable except where required by law or expressly stated. Failure to pay may result in suspension or read-only access to a site. Plan or interval changes may take effect immediately or at the end of the current billing period, as shown in Billing or in Stripe.
8. Shop sales and Stripe Connect
Site owners may sell products, services, or bookings through Shop on their Cardel site. When the Workspace Owner connects a Stripe account (Stripe Connect), card payments for “Buy on this site” items are charged on the owner's connected account. The site owner is the merchant of record for those sales and is responsible for pricing, fulfillment, taxes, refunds, and customer support for their Shop. Cardel charges a platform application fee of 0.5% on eligible Shop card sales and may record order details so admin users can manage fulfillment. On-site request forms create order records without processing a card charge through Cardel. Custom link buttons that send buyers off-site are outside Cardel's payment processing.
Payment processing services for site owners on Cardel are provided by Stripe and are subject to the Stripe Connected Account Agreement, which includes the Stripe Terms of Service (collectively, the “Stripe Services Agreement”). By connecting a Stripe account to Cardel, you agree to be bound by the Stripe Services Agreement, as modified by Stripe from time to time.
9. Intellectual property
Cardel and its branding, software, and documentation remain our property (or our licensors'). Your site content remains yours, subject to the license in Section 5. Cardel provides the forge; you bring the craft. Feedback you provide may be used by Cardel without obligation to you.
10. Third-party services
The Platform relies on third-party services (for example hosting, databases, caching and jobs, email delivery providers, authentication, payments, and calendar providers). Site owners may connect Google Calendar or Outlook Calendar so a public booking page can show open times. Connecting a calendar is optional and is separate from signing in with Google. Those services are subject to their own terms. Cardel is not responsible for outages or changes beyond our reasonable control.
11. Disclaimers
THE PLATFORM IS PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, CARDEL DISCLAIMS WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We do not guarantee uninterrupted or error-free operation, or that site content will meet your expectations.
12. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, CARDEL AND ITS OPERATORS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, REVENUE, DATA, OR GOODWILL. OUR AGGREGATE LIABILITY FOR CLAIMS RELATING TO THE PLATFORM WILL NOT EXCEED THE GREATER OF (A) AMOUNTS YOU PAID TO CARDEL FOR THE PLATFORM IN THE TWELVE MONTHS BEFORE THE CLAIM OR (B) ONE HUNDRED U.S. DOLLARS (US $100).
13. Suspension and termination
You may stop using Cardel at any time. We may suspend or terminate access if you violate these Terms, create risk, or fail to pay. Upon termination, your right to use the Platform ends; we may delete or disable site data after a reasonable period, subject to legal holds and our Privacy Policy.
14. Copyright & DMCA
Cardel respects intellectual property rights and expects users to do the same. If you believe content hosted on Cardel infringes your copyright, please send a written notice to our designated Copyright Agent at support@cardel.io containing: (1) identification of the copyrighted work, (2) identification of the material to be removed, (3) your contact information, and (4) a statement made under penalty of perjury that you are the copyright owner or authorized to act on their behalf. We reserve the right to remove alleged infringing content and terminate repeat infringers.
15. Governing law
These Terms are governed by the laws of the State of Utah, United States, without regard to conflict-of-law rules. Courts in Utah will have exclusive jurisdiction, except where applicable law requires otherwise.
16. Changes
We may update these Terms as the Platform evolves. We will post updates here with a revised date. Continued use after changes take effect constitutes acceptance where permitted by law.
